Terms and Conditions
Effective Date: June 18, 2025

These Terms and Conditions ("Agreement") govern the relationship between Cedar & Ash Digital Marketing ("Company", "we", "us", or "our") and the client ("Client", "you", or "your") for the provision of photography, videography, and related digital marketing services.

1. Ownership and Usage Rights

1.1 Client Rights
Upon full payment, the Client is granted a royalty-free, perpetual, non-exclusive license to use, reproduce, display, and distribute the final media content (photos, videos, or other deliverables) produced by Cedar & Ash Digital Marketing for personal or commercial use, including but not limited to advertising, marketing, social media, and website use.

1.2 Company Rights
Cedar & Ash Digital Marketing retains the right to use any and all content created for the Client for portfolio purposes, promotional materials, advertising, website, social media, and other marketing efforts, unless otherwise agreed upon in writing prior to the project start.

2. Content Delivery and Revisions

We will deliver the final edited content in a timely manner, as outlined in the project agreement. Any requested revisions beyond the agreed scope may incur additional charges.

3. Third-Party Usage

The Client may not sell or sublicense the content to third parties without written permission. Third-party collaborators or agencies working on behalf of the Client may use the content in the Client's campaigns, provided the Client ensures proper attribution and legal compliance.

4. Credit and Attribution (Optional)

While not mandatory, we appreciate being credited when possible (e.g., "Photo/Video by Cedar & Ash Digital Marketing"). This supports our continued visibility and professional growth.

5. Confidentiality and Privacy

We respect the confidentiality of all proprietary information shared during the course of the project. Any request to withhold specific content from public promotion (e.g., private property details or minors) must be made in writing before content delivery.

6. Limitations and Liability

We are not liable for indirect damages, loss of profits, or third-party claims resulting from the use or misuse of the delivered content. The Client is responsible for ensuring proper usage and compliance with advertising standards and regulations.

7. Amendments

We reserve the right to update or modify these Terms and Conditions at any time. Clients will be notified of any significant changes prior to enforcement.

8. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Idaho, without regard to conflict of law principles.

9. Cancellation Policy

We understand that plans can change. However, cancellations made on the day of a scheduled appointment will result in a $50 cancellation fee. To avoid this fee, please cancel or reschedule at least 24 hours in advance of your scheduled time.
By booking with Cedar & Ash Digital Marketing, you acknowledge and accept this policy.
